Here are a few examples of recent favorable results obtained by our attorneys on behalf of health care providers:
- Summary Judgment Granted: Plaintiffs filed a wrongful death lawsuit in the United States District Court for the Western District of Missouri against a hospital and various medical providers alleging that all were negligent, either directly or vicariously, for failing to diagnose and treat the decedent for toxic shock syndrome. After several co-defendants had settled, the attorneys at Douthit Frets were able to obtain voluntary dismissals and summary judgment on behalf of all of their clients.
- Directed Verdict Granted: Plaintiff filed a lawsuit in the Clay County Circuit Court alleging that, due to a raised area in the rug in the entrance to the hospital, the hospital's property was in a dangerous condition. The attorneys at Douthit Frets were able to obtain a directed verdict in favor of the hospital on the basis of sovereign immunity at the close of the plaintiff's evidence.
- Defense Verdict: A defense verdict was obtained on behalf of an emergency room physician and physician corporation in a case involving the brain damage of an infant. This case was recognized by Missouri Lawyers Weekly as one of the top ten defense verdicts that year.
