EXPERIENCE

Greg is an experienced trial lawyer who has successfully resolved business and commercial disputes for clients since 1987. He is committed to finding a business answer to his clients’ problems and disputes. He has worked with individual entrepreneurs, small businesses and America’s largest companies to craft cost-effective and valuable solutions that focus on the client’s principles and goals. Greg has successfully handled disputes ranging from straightforward contract breaches to complex issues in condemnation, real estate development, warranty, corporate transactions, probate and trust challenges, and class actions. His dispute resolution experience includes mediation, and arbitration, as well as administrative, bench, and jury trials in Kansas and Missouri.

In addition to a litigation and dispute resolution practice, Greg’s experience on the City Council of Kansas’ second largest city, and in politics and public service generally, has led to a successful practice in land use, zoning, real estate development, and permitting. He has developed a unique perspective on state and local government land use, zoning, and development opportunities. Greg has represented owners and developers in projects as diverse as multi-family, office, hotel and restaurant, and significant mixed-use projects in the greater Kansas City area.

Greg has successfully assisted clients navigating the federal, state, and local permitting and regulatory process for renewable energy projects involving solar and wind energy across the country. With his roots in rural Kansas, he understands the opportunities such projects offer the local and larger economy and the process of evaluating and mitigating concerns of local residents.  Greg’s diverse practice also includes work on real property issues such as eminent domain, acquisition of economic development incentives, valuation of real property, and property tax appeals and exemptions.

REPRESENTATIVE Experience

  • Defended Kansas governmental authority in an alleged breach of contract action brought by multi-billiondollar waste and recycling company and won summary judgment in federal district court, which was unanimously upheld by the 10th Circuit Court of Appeals.
  • Led multi-faceted project team in obtaining rezoning approval for a combined multi-family and retail project responding to legal and factual opposition by area neighborhood.
  • Successfully tried a property tax dispute regarding appropriate legal and factual valuation process for rural electric cooperatives resulting in an order revising methodology for property tax appraisal and assessment.
  • Obtained rezoning approval in suburban Kansas City community for mixed use development including multi-family housing, general and specialty retail, and vertical and horizontal office uses.
  • Partnered to ensure economic development base for erection of a major youth sports complex and mixed use retail/entertainment/office/residential development.
  • Lead a successful team effort to rezone and promote expansion and redevelopment of the largest single mixed use campus in Kansas.
  • Successfully prosecuted rezoning and special use permit applications for a 26-acre mixed residential use project including assisted living, independent living and 200-plus town homes
  • Obtained special use permit for significant assisted living facility over neighborhood opposition
  • Achieved restructuring of major financial incentives, including Tax Increment Financing, Transportation Development District and municipal government loan, for stalled mixed use project and preservation of historic buildings
  • Successfully obtained required permitting and land use entitlements for development of wind and solar energy projects, including providing assistance in submitting, prosecuting and obtaining state tax exemptions and payment in lieu of taxes (PILOT) agreements for renewable energy equipment and facilities
  • Provided research, analysis and strategic advise regarding city, county and state laws, ordinances and regulations applicable to renewable energy projects, including drafting appropriate text and ordinance amendments and advocating to responsible governmental bodies
  • Achieved a defense verdict following a two-week jury trial on claims of misappropriation of trade secrets
  • Obtained summary judgment on all counts in a Kansas state court lawsuit alleging misappropriation of trade secrets, tortious interference and unfair competition
  • Won summary judgment in federal court on behalf of major telecommunications company on claims for contractual indemnity
  • Successfully acquired lengthy right-of-way for natural gas pipeline in Missouri, including negotiation and exercise of condemnation rights
  • Challenged compensation award by Missouri city for expansion of its airport and successfully attained significantly more favorable award
  • Litigated and obtained favorable jury verdict for aviation manufacturer against breach of contract and warranty claims
  • Prosecuted claims on behalf of national charitable hospital organization to obtain favorable distribution of estate and trust assets
  • Represented many owners and developers in obtaining zoning or plan approval, including public-private incentives, for development of retail, office, mixed-use, residential properties, and renewable energy (wind and solar) projects
